Government figures show that the number and rate of accidents involving slips and trips have increased in number since the last decade. In 2002/03 they accounted for 10,458 out of a total of 28,426 reported major accidents to the public. These figures represent almost half of all non-fatal injuries to members of the public and remain the highest cause of major accidents in the UK.

The most common causes of such accidents are spillages on floors and badly maintained pathways, but slips and trips can occur anywhere and for any number of reasons.

All public areas must be designed and maintained to ensure the safety of the public. Similarly, all Local Authorities have a duty of care to ensure that all public roads and pavements are free from hazard.

Can I Claim?

If an authority or business has failed in ensuring public safety and as a result you have been injured, then you may be entitled to claim for compensation. You may have slipped in your local supermarket or tripped in the street, as long as it was within the last three years you could make a claim.

What to do?

To make a successful compensation claim, you would need to be able to prove that another person was responsible for your injury.

To support your claim, you should report the accident to the person who is responsible. This may be a store manager or your local council official depending on the situation.

If possible take names and addresses of any witnesses and take photographs of the area where the accident happened. In cases involving badly maintained pavements, place a ruler beside the defect to give an idea of depth/height. You may also be able to claim expenses such as prescription costs or travelling expenses. Remember to keep receipts as evidence.
